These Terms of Use (“Terms”) govern your access to and use of Shaping Minds ABA (the “Service”), an independent study tool offered by the operator of this application (“we,” “us,” or “Shaping Minds ABA”). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility & account

You must be at least 18 years old (or the age of legal majority in your jurisdiction) and able to form a binding contract to use the Service. You are responsible for the confidentiality of your account credentials and for all activity under your account.

2. Subscription & billing

Access to study content is offered on a paid monthly subscription (currently $5.00 USD/month) billed through Stripe. By subscribing you authorize automatic recurring charges to your selected payment method until you cancel. You may cancel at any time from the in-app Dashboard; cancellation takes effect at the end of your current billing period and you will retain access until then. Except where required by applicable law, fees already paid are non-refundable.

3. Educational use only — no guarantee

The Service is provided for personal study and self-assessment purposes only. Practice items, mock exams, explanations, and analytics are study aids and do not guarantee any specific outcome, including passing any certification exam, eligibility for certification, or competence to deliver clinical services. We make no warranty, express or implied, that use of the Service will result in passing the BACB®, BCBA®, BCaBA®, RBT®, or any other examination.

4. No professional advice

Content provided through the Service is for general study and informational purposes only and does not constitute clinical, medical, legal, or professional advice. You should not act, or refrain from acting, on the basis of any content from the Service without seeking advice from a qualified professional.

5. Trademarks & no affiliation

BACB®, BCBA®, BCaBA®, and RBT® are registered marks of the Behavior Analyst Certification Board, Inc.® The Service is not affiliated with, endorsed by, sponsored by, or approved by the BACB® or any other certifying body. References to these marks are made in good faith for descriptive identification of the examinations the Service helps users study for.

6. Acceptable use

You may use the Service only for your own personal study. You agree not to (a) reproduce, redistribute, sell, or publicly display the questions, explanations, or analytics; (b) reverse engineer or attempt to extract underlying data; (c) use the Service to create a competing product; or (d) use the Service in any way that violates applicable law or the rights of others.

7. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION. WE DO NOT WARRANT THAT QUESTION CONTENT, EXPLANATIONS, OR ANY OTHER MATERIAL IS COMPLETE, ACCURATE, OR ALIGNED WITH ANY CURRENT EXAM BLUEPRINT.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL SHAPING MINDS ABA, ITS OWNER, OPERATORS, CREATORS, CONTRACTORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING WITHOUT LIMITATION ANY EXAM RESULT, CERTIFICATION DECISION, OR EMPLOYMENT OUTCOME. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) US $20.

9. Indemnification

You agree to indemnify, defend, and hold harmless Shaping Minds ABA and its owner, operators, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service or your breach of these Terms.

10. Termination

We may suspend or terminate your account at any time, with or without cause or notice, including for violation of these Terms. You may stop using the Service at any time and may cancel your subscription from the Dashboard.

11. Changes to the Terms

We may update these Terms from time to time. Material changes will be communicated through the Service. Continued use after changes take effect constitutes acceptance of the revised Terms.

12. Governing law

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Florida, and you consent to personal jurisdiction in those courts.
